Charged with a DUI over the holidays? What to do now?
If you received a misdemeanor DUI over the holidays, your first court appearance is coming up! After you were processed by police, they probably gave you a ticket from the arresting officers before you left the police station or DUI van. The ticket will have your court date on it.
This court date is known as the Arraignment date. That is the date where you will appear before a judge to hear a reading of the formal charges against you. If you plead not guilty, you will be given an opportunity have a pre-trial hearing to view the reports, test results, and other evidence that the prosecutor has in their control.
Since it is the State’s burden to prove their case, it can be beneficial to have an attorney represent you at either of these stages to ensure that the evidence was obtained according to law, to determine if the evidence is sufficient, and to consider whether disclosing your own evidence. In the end, you will have the option to go forward with a jury trial or to settle the matter through a plea agreement. Having an attorney when making this decision ensures that you are making the best choice.
